Abstract

Judicial activism has played a critical role in shaping the human rights landscape in Pakistan, particularly in areas where legislative and executive branches have failed to adequately protect citizens' rights. This paper explores the role of judicial activism in enhancing human rights protection in Pakistan, particularly in safeguarding fundamental rights guaranteed by the Constitution, including the right to a fair trial, freedom of speech, and protection from unlawful detention. By examining landmark Supreme Court cases such as Shehla Zia v. WAPDA (1994), Suo Motu Action Cases, and Zafar Ali Shah Case (2000), the paper highlights the judiciary's proactive role in addressing constitutional violations and social justice issues. However, judicial activism is not without its challenges, including accusations of judicial overreach, limited institutional support, and political resistance. The paper also explores comparative perspectives, drawing comparisons with India and the United States, to understand the broader implications of judicial activism in human rights law. Finally, the paper discusses future prospects and reform recommendations to ensure a more balanced approach to judicial activism, focusing on judicial independence, enhanced legal frameworks, and improved human rights protections in Pakistan.
